Department of Justice (DOJ) Inspector General Michael E. Horowitz announced today the release of a report on the Drug Enforcement Administration’s (DEA) and Federal Bureau of Investigation’s (FBI) compliance with artificial intelligence (AI) and other emerging technology requirements contained in the National Defense Authorization Act for Fiscal Year 2023 (FY 2023 NDAA). The FY 2023 NDAA requirements apply to U.S. Intelligence Community (USIC) elements, including the FBI in its entirety and the DEA’s Office of National Security Intelligence (ONSI).
The DOJ Office of the Inspector General (OIG) found that both FBI and DEA ONSI are in the early stages of AI integration but have made some progress to integrate AI and comply with the FY 2023 NDAA requirements.
The OIG’s findings included the following:
- Efforts to Integrate AI. FBI has published an AI policy, established an AI Ethics Council, and is inventorying its AI use cases. DEA ONSI has leveraged a partner USIC member for its one AI tool. We believe both agencies could benefit from assessing their AI needs with the goal of enhancing intelligence collection and analysis.
- Barriers Impeding AI Adoption. FBI and DEA identified funding constraints, difficulties hiring and retaining a technical workforce, vendor transparency, and the need to modernize data architecture as barriers to the accelerated adoption of AI.
- Compliance with Other FY 2023 NDAA Provisions. The FBI and DEA could not complete 10 of the 15 required provisions in the FY 2023 NDAA because action from the Office of the Director of National Intelligence was required first. Of the remaining five provisions, DEA ONSI completed four and the FBI completed three. The remaining required provisions of the FY 2023 NDAA are: both FBI and DEA ONSI need to submit a report to Congress on their AI efforts, and the FBI must delegate other transaction authority to purchasing officials.
The DOJ OIG made five recommendations to improve the DEA’s and the FBI’s efforts to comply with the FY 2023 NDAA. The FBI and DEA agreed with all five recommendations.
